I work for a company in Virginia. We have run into a problem, we give 2 (15 min breaks paid and 1/2 lunch break unpaid. We have let people that do not take 15 minute breaks to use it towards their lunch, so they will take a 1 hour lunch but be paid for 1/2 for it. Is this the right way? Should it be that you take the break or lose it. We want to make sure we are fair to the people taking breaks and non break people.

Personally, I would not allow that. Since you are already offering more than the law requires, you can specify when breaks are used. If they choose not to take a break, that's fine, but you're not going to give them an extra 30 minutes for lunch (paid or unpaid) because of it.

Just my $.02, but I think you'll find others agreeing here as well.
