We have a workplace rule that states that if you are going to be late or absent, you must call in at least one-half hour prior to the start of your shift. We have an employee who has a certification for a serious health condition for her child. Even though we do not count her FMLA absences toward our attendance system, can we still require that she follow the call-in rule?

CAn you tell me where I can find this info? She is claiming that her asthmatic son is having an attack at the exact time she has to call in. This has happened three times in the last few months.

I don't have tiime at this precise moment to go through the FMLA statute and find the exact site, but you can check yourself on the US DOL website.
