:( hi.I was living in ny at the time that this all started and my ex took me for child support for my son, and i was stupid. Not paying for child suuport caught up with me. my license was taken a way as a result. i have two kids now and live in fl with my wife and she keeps telling me to get advice from a lawyer to find out if i can get my license back, now that i'm working two jobs and they take out money to pay the child support. Not only that but through out this whole time she's been taking my son in and out my life and i want to see my son. she was on welfare when i was in ny and she was jumping from home to home and disapperd around thanks giving time come back around feb. she did for two years straight , Me and my wife tried to help her out but it is like if she dont want us to help her. my son is five, my wife put him in school and picked him up at 8 in the morning and drop him off at 3, so she could do what she had to do. she pulled him out of school. Me and my wife had him for weekends,now we dont. My wife use to take him to doctors appointments. She now moved to fl to live with her brother in jacksonville. We dont know exactly were. i just want to see my son.

You DL should have been reinstated as soon as you started paying again. Is there an outstanding warrent or contempt charge that hasn't been taken care of? If you have lived in Fl for at least 6 months you can go to the DOR CSE office to get the license back. If you don't know where the local office is you can find it by calling 1-800-622-5437. Even if the CS order is still in NY, Florida CSE can help, because it is now an interstate enforcement case. Are the payments being garnished from your pay by the state?

If there isn't a visitation order already, you need to file for an order. If there is one already you will need to have it enforced, and possibly modified.

DOR CSE is short for Dept. of Revenue Child Support Enforcement. Custody is different than visitation. In your case, I believe it means that your ex has total sole legal custody, meaning that there isn't any joint custody. Basically it means that she has total say so concerning your son. If there isn't any visitation order, you will need to petition for that, because it isn't done automatically.

Call the number I gave you and speak to CSE about getting DL reinstated. They only handle CS issues , not custody/visitation, so you'll either need an attorney for that or do it yourself.

I get paid four hunderd dollars bi-weekly in my first job, they take two hunderd bi-weekly out of that.I get paid two hunderd dollars weekly in my second job. They going to take one hunderd out of that weekly. What am I going to do to feed my other two kids if I have bills to pay and rent. My wife wants to work but then if she works we have to pay child care, that over here is one hunderd and fifty dollars times two on a weekly bases. she will be working to pay child care i rather let her stay home with the kids.sometime i just want to give up, but my three kids are my life. i love them so much. No, they cannot garnish your second job. I have to go to the Dr. in a few minutes, so I don't have time right now to find the statute, but when I get back later I'll post the statute and a link to where you can print it out and send it to CSE.

I can't remember which statute it is, but the statute says that if a NCP has a second family that the income from a second job cannot be used for calculating CS. I have been told by a friend that this also means they cannot garnish the second job either. You can read through the statutes to find it and then print it out to send to CSE. www.flsenate.gov/STATUTES/

You'll find it in either chapter 61 or chapter 88.
