My sister in law just gave her company in Georgia a two weeks notice from her job as office manager. The next day, when she reported to work, she was told by the Vice President to just go home and not return. They refuse to pay the two weeks notice, which I understand is not illegal if it's not against company policy. However, they also refuse to pay for one weeks vacation time that she has saved up. Is that legal? She had been office manager for over a year. Thanks in advance.
GA law does not require that an employer pay out unused vacation time.

can you point me somewhere that has these laws in writing?
we just had some employees quit that are expecting unused vacation and sick pay and I want something legal to show them why they will not be receiving. (not that a printed out message board post doesnt look legit or anything :) )
I've been searching all over ga dol site and cant seem to find
also looking for the law that says in ga you do not receive your finally paycheck until the next payday
thanks

It's not that there is a law that says it needn't be paid out, it's that there is no law that says it does. When the law is silent on an issue, it then becomes the employer's option. You can't prove a negative.

Does this also apply to a terminated employee with accrued vacation? Is there a federeal law that requires payment if there is not a state law in GA?

No, there is no federal law addressing this situation. That's why we say it's state-specific. If there were a federal law about it, there wouldn't BE state laws and we would refer to the federal regulation.
