State of GA- I gave my two week notice on 02/06/06, my 1 year aniversery date was 02/03/06. I am suppose to get 1 week paid vacation after being there one year. However, I have nothing in writing that state this. Do I get this vacation time on my final paycheck?

The state of Georgia does not require that unused vacation time be paid at termination. If your employer chooses to pay it, they may. If they choose not to, it is legal.

That's because there isn't one. It's not that there is a law saying employers do not have to pay out vacation time at termination; it's that there is not a law saying that they do.
The law specifies what an employer MUST do, and what an employer CANNOT do. It does not spell out what an employer MAY do.
In Georgia, and in many other states, an employer MAY pay out vacation time if they choose to. There is no law saying that they may not. But they are also not required to do so. So there is also no law saying that they must.
In the absences of a law either requiring that they do pay it, or forbidding them to pay it, it is up to the employer to decide. There is no law addressing the situation at all.

I quit my job 2/7/06. At my anniversary ,which was 1/26/06, I received two weeks vacation. Upon my notice I left the day of, because if you accept a job with a competitor..they will escort you out . Prior to my notice, 1/30 -2/3...I was on "flex days" or discretionary paid days off. My last check 2/7/06. check only paid 2 weeks vacation and not the "used flex/ discretionary" days. Our company handbook states that "any unused flex days will not be paid out upon termination". Since I used the days prior to leaving, I feel I should be paid for them. Another co-worker also left the company and prior to him leaving, he had used 4 vacation days. His manager changed those days to "flex" and paid his vacation and used flex. I spoke with payroll and Human Resources and they refuse to speak to me and asked me to call my manager. They also stated that it was a payroll policy not to pay me. I sent Payroll a certified letter and asked for a copy of the policy and have yet to receive one. I called Georgia Dept of Labor and there is no law forbidding them to pay or not to pay. The reason I left the company is because of pay issues. I tried to file an EEO complaint...but needed more proof. I would like to file a civil suit sgainst this company.
