View Full Version : Overtime/Vacation time in Oklahoma

I have been working for a bank in Oklahoma and have a couple of questions. The bank was bought by a Texas base bank. When working overtime they pay half time and today I gave my resignation and found that now I do not get my vacation pay. I have been on the job for 1 1/2 yrs. Is this legal ?

The laws of your work state apply, regardless of where the corporate office is.

Unless you have agreed to be paid under the fluctuating workweek method, overtime must be paid at 1.5 time for nonexempt employees.

I could not find a law in Oklahoma requiring payout of vacation at termination. cbg?

I'm having trouble accessing the OK state website and my sources conflict on whether vacation is payable at termination in your state. The more reliable source indicates that vacation time is payable at termination unless company policy says otherwise.

For the record, Texas law does not require the payout of vacation at termination unless company policy says it does.

I'm so glad I found this site.
I have been employed at a small daily newspaper in southeast OKla. for two years. I have approximately a week's worth of vacation time. I have recently given my two weeks notice and was told that I would not be paid for my vacation time. Here is the thing. My paper is owned by a corporation and we have NO employee handbook, the joke around the office is that we don't have one so that the bosses can make up stuff as they go along. I have never seen a policy regarding this in any way shape or form. The company paid a department head his vacation time last year when he resigned to take another position, but they didn't pay it for several others. I was told that it is up to the publisher on site to consider on a case by case basis. However, when I asked for it to be paid I was told that the policy was that when an employee submits a resignation they forfeit their right to any benefits regarding paid leave. Now I understand about not being able to be paid for sick days, but the vacation thing without any written policy when they have paid it in the past seems illegal to me. I feel like that as an employee I did the responsible thing and submitted a resignation giving notice instead of coming in and requesting my vacation then quitting after I got back from leave. Can anyone help me. I only want the 4 and 1/2 days which I have already earned and feel that I am entitled to? thanks
