I have been with my job for 8 years now. There are about 200 employees give or take.
For starters, my company does not provide maternity leave, instead is an unpaid leave of absence. Is this legal?
Second, as for sick calls. We are allowed a total of 4 "free" sick calls for teh year, after 4, we get warned and then written up. When I asked my manager about morning sickness and if I go over my 4 "free" ones, if I still get slapped in the hand, she said yes. I have talked to other family memebers and friends about this, and they have never heard of such a thing let alone not getting maternity leave.
Does my job have a right to do this??

They have no legal obligation to provide paid maternity leave. The only thing the law says is that pregnancy must be treated exactly the same as other medical leaves. If that's how they handled all medical leaves, then it's legal for you.

As far as the sick time is concerned, the policy is legal up to a point. However, if you have worked for this employer for over 12 months, and they have more than 50 employees within 75 miles of your location, and you have worked 1,250 hours within the last 12 months, then your pregnancy and any missed time related to it would be covered under FMLA. That would mean that you can take up to 12 weeks of unpaid leave with your job protected. This 12 weeks includes EVERYTHING to do with the pregnancy, including the leave for the actual birth and any bonding time afterwards. They have no obligation to provide more than 12 weeks. The more time you take off now, the less time you get later. They CAN require that your four paid sick days be included in this time.
