Please tell me if you think? Let me first say I have never been out sick except this one day that Monday, I was sick sat, sunday and called my boss on sat night and again sunday morning to tell her I was sick so they could get someome to cover me on monday (she told me to call her monday morning since they can never find coverage for me and let her know if there was anyway I could make it in) On monday at 6am I call and told her no but I would be in on tuesday. I sensed she was upset but I was not feeling well and being the nurse I felt in the best interest of the patients it was better if I took this day at least to recover until I returned the next day. The rest of the events follows on the letter. Also after quiting and I picking up my paycheck & I have been unable to cash it due to NSF. I have always been lucky before and able to cash it but not this time. (that is another problem I did not mention in the letter the practice is a little broke and we always feared our checks would bounce one day) Here is the letter I gave when I quit and will be presenting to UI with the bad check.

Letter of Resignation

To: Office Manager
Cc: Dr. blank

It is with deepest regret that I am turning in my letter of resignation. There has been several problems that I have been trying to overlook during my time here at (Blank), however I feel that I can not tolerate when I my employer will retaliate against me for being out sick. I did not understand why I was told that I was to stay home on Tuesday because of a lack of patients (only 10 on the schedule) then come to find out there were more. You stated (Blank) did not want to pay four people to come in and work with such a small amount of patients, however, you still paid another nurse to do my job thereby cutting me out of my pay. At no time did you ask how I was feeling or did you state she felt it was a waist of my time to come in if I was still feeling sick, until I returned to work and told you I was upset about how she handled the situation. By bringing another person in to do my job, I feel was an act of retaliation and not the practices way to save money.
I have also explained to you that the reason I am having a hard time getting the scheduling done is because (blank) documentation in the carts is either incomplete or inconclusive. Also when she asks for a test to be done she does not always say why (blank) wants it done. Most of the time I have to chase after her to find out why and this delay’s the scheduling time. I have mentioned this and according to other staff members this has been an ongoing problem. I also feel that everyone was aware that I would be returning to school and that my work hours would be less once I started school, even to a point that we talked about a schedule change, however, now it seems to be a problem. I feel the complaints about the scheduling are mainly due to me not being here the 40+ hours I use to be, rather than the work not being done. I say this because of the comments made by (blaks) to patients about me leaving the practice. When I complained about the unfairness about this you told me “it’s up to her, she can do what she wants to do” and you’re right. However, I don’t feel working in this environment is in the best interest of anyone. I wish you all the best of luck.

It's unclear to me what your question is. What is it that you are looking for from us? I"d like to help but I'm not sure how.

do you think I will be awarded UI?

No, I don't. It's next to impossible to get UI if you quit. I could be wrong but I think it's very unlikely that the UI office will agree that you had a compelling reason to quit. Especially in a state like GA, which is very employer friendly.

also how can I recover my money and what action can I take from the not having my pay for the days.

That depends on whether you are exempt or non-exempt. If you are exempt, it further depends on the company's sick time policy, if any. If you are non-exempt, they have no legal obligation to pay you when you do not work, regardless of why you did not work.

I would not say that I have received UI before when I quit for harassment, however the empolyer did write a statement in support this. This is a little different in that I am working in a place where we may or as you can see may not get a paycheck...Well I will let you know the outcome.

I meant on recovering my money for the bounced check. I still have not been able to get the money for the paycheck that will not clear.

If you were subjected to illegal harassment, yes, most states will grant UI if you quit for that. But not in the situation you describe in this post.

You can file a complaint with your state DOL to get the money from the bounced check.
