View Full Version : i feel i was fired because i had a injury on the job..what is the texas state law on

undefinedi was working in the rain with our maintenance man trying to put the trash in the dumpsters when i tried to move a desk i pulled my back very badly..i was put on lite duty for 6 weeks. my doctor put me back on full duty to see how i could handle the work but after a week for full duty i had told my boss that my back wasnt any better and i wanted to talk to the doctor about a mri and she walked away from me like i never even spoke to me..less then a week later i was fired! i was not fully released from the doctors care until 2 days after i was fired..he told me since i was fired he had no choice but to release me and i would have to fight it out with my employer on any medical treatment from then on...when asked why i was fired my boss told me i broke policy and when asked details she couldnt give them to me. what can i do? is there a law that protects people like me?..if someone can help me please feel free to contact me ..thank you

Texas, like many states, protects employees filing a workers compensation claim from retaliation. This certainly sounds like retaliation. Texas labor code states, "§ 451.001. DISCRIMINATION AGAINST EMPLOYEES PROHIBITED. A person may not discharge or in any other manner discriminate against an employee because the employee has:
(1) filed a workers' compensation claim in good faith;
(2) hired a lawyer to represent the employee in a claim;
(3) instituted or caused to be instituted in good faith a proceeding under Subtitle A; or
(4) testified or is about to testify in a proceeding
under Subtitle A. Acts 1993, 73rd Leg., ch. 269, § 1, eff. Sept. 1, 1993. "
