I worked for an AHCCCS contracted insurance company for almost three years here in Arizona. Friday at 4:00 pm I was asked to attend a "meeting" regarding a new process that I had suggested. At that time I was told I was going to be discharged due to changes in our contract with the state, that said the position I held had to be filled by "licensed medical personnel" Flat out laid off!!! I was not even given an option to be moved to another area until, I questioned them, and then they gave me areas where either I did not have experience, demotion or it again required a nurse. When I was hired I told them that I did not have a license and the manager at that time did not have a problem with it, "as long as I was directed by a "medical person" it would be ok. In the exit interview, it was expressed to me that "management" had been in a quandry for TWO MONTHS as to where they could "put" me within the company. I was in the Quality Management dept, however 90% of the work I did was related to the Utilization Management department, and I had been doing it from the inception of the company since 9-15-03 hire date. I asked them to create a position for me within the UM department doing the exact same work. They said that was impossible,no money????. I feel that I was discharged without fair warning. They knew for two months they were going to have to make this decision. They could have informed me so I could have started looking for another position, now I am without a job, a diabetic with no insurance. What can I do to force the company to give me back my job

There is nothing you can do to force them to give you your job back. While you may not like the way they handled things, they did nothing illegal. Nothing in the law says they have to tell you in advance that you are being laid off except in circumstances of mass layoffs that do not apply here.
