View Full Version : vacation time denied, then terminated

My wife worked at a day care for almost 3 years in Indiana. Latley her boss has been sort of a jerk to her, and being mean all the time. My wife tried to use her Paid Time Off days for vacations and the sort but her boss told her no. She recently went to work, and before she could punch in, her boss fired her. I called down there wanting to know if my wife was going to get paid for the drive time to get there, and about the PTO days she had, her boss just hung up on me. Are we entitled to some compensation for her driving there, and are we entitled to the two PTO days she was denied the use of? Isnt there some Indiana law for that?

She is not legally entitled to drive time to go in just to be fired. And there is no "reporting pay" law in Indiana. Indiana does not have a law that requires PTO (vacation) be paid out at termination; although I have just heard from a respected colleague that Indiana case law has supported it. For the PTO payout, if it is substantial, it might be worth contacting an attorney versed in employment law.

And, if I may make a suggestion, you stay out of it. There's not very many things that make an employer less amenable to a possible settlement with a fired employee than a nonemployee spouse. Let her deal with it.
