Is it legal for a privately owned company to pay an employee vacation time in lieu of overtime?

Currently I work hourly with overtime and no vacation time. I wanted to know if I could roll my overtime hours into a vacation bank and take them as paid. I thought it best to check and see if this was a legal option as I understood this was only available to government employees. ;)

In the private sector, legally, overtime must be paid when earned, even if the emloyee requests compensatory time (which is really what you are asking for) and the employer were to agree. I would be wary of the employer who agreed to this arrangement.

Or, to put it in other words, no, that is not legal unless you are a govt employee.
