My wife is in her 3rd Trimester, and her company just recently provided an employee manual that states the following:
A family or medical leave of absence is defined as an approved absence available to eligible emplyees for up to twelve weeks of unpaid leave per year. Although not subject to the Federal Family medical Leave Act (FMLA) due to its size, the Firm has currently elected to apply the following provisions subject to modification as the firm deems necessary:
1. On the birth of an employee's child
2. When an employee is needed to care for a child, spouse, parentsm, or parent-in-law who has serious health condition
3. When an employee is unable to perform at least on eof the essential functions of his/her position because of the employee's own serious health condition (including any incapacity associated with pregnancy)
4. On the placement of an adopted or foster child with an employee
Since my wife will be having a C-section- can we take 4 wks prior to the baby's birth date, and the remaining 8 weeks after the child birth? Or can she work all the way up to her due date and take the whole 12 wks?
Can she apply for benefits online? and if so - what links and what are the benefits she can get during these 12 wks?
any help will be MUCH appreciated.
