Hello..

This is my first pregnancy. I currently work for a Walmart SuperCenter in IL. I informed my work of my situation. My Boss told me that If I can not work due to being pregnate. As if my doctor should say I need light dutey or alternate work. They Told me they do not provide Light duety and I would have to take a LOA. Which as far as I know. LOA-No money-No income-No insurance.

Is this right? Can they do this?

Thank you

DID your doctor say you need light duty or alternate work?

My normal doctor didnt say anything, but since I was born with NF she told me to tell that to my OB, when I go see her/him in a few weeks, and mention it. I had only told my work that I was pregnate, and that is when she told me IF I should need Light dutey It would not be given to me. Although they let every other pregnate lady another job there, as well as let one sit in a rocking chair behind a counter and do nothing.

Sorry It took so long to reply I am sick as well.

Thank you for helping

They can SAY anything they like. It's whether or not what they DO is illegal, that counts.

In addition, pregnancy is not considered a disability under the ADA in 99.99% of cases, and therefore is not entitled to accomodation.

An employer is not required by law to provide light duty. It may be that all the light duty jobs are taken and they have no more available. That's legal.

What it boils down to is that you're going to have to wait and see what they do, before we'll be able to say if there are any illegalities or not.
