Iam a part-time emp. at winn-dixie an 3 months pergnant i was woundering what is the maternity leave law for part-time emp. who has been there 7 months? :confused:

Florida does not have any maternity leave laws for either full time or part time workers.

If your employer has 50 employees within 75 miles of your location AND you have worked for them for no less than 12 months AND you have worked no less than 1,250 hours in the last 12 months then under Federal law you are entitled to a total of 12 weeks of unpaid leave with your job protected. If you do not meet ALL of the criteria listed above then you are only entitled to exactly whatever leave your employer would offer to a similarly situated part time worker who had a non-maternity condition.

whats the leave law for emp. to a similarly situated part time worker who had a non-maternity condition.

Okay, let me try again.

There is no law in Florida that requires an employer to offer ANY employees maternity leave.

If your employer would offer a similarly situated part time worker with a non-maternity condition two weeks, you get two weeks. If your employer would offer that employee six weeks, you get six weeks. If your employer would offer that employer three months, you get three months. ALL the law says is that you are entitled to receive the same amount of time your employer would give to similarly situated part time employee, whatever amount of time that might be.

Does that make it any more clear? :)
