:confused: i have a friend that works for macy's in miami-dade. she is 5 months pregnant and has a high risk pregnancy. she asked her supervisor about keeping her job if she had to go on maternity leave ealy due to her needing to be on bed rest. she was told that they can not promise her that she will keep her job but as a favor cause she likes her and is a good worker she can hold her position for a couple of months but not for long. is this true see i just moved her to florida from california and i know that in california they can't do that to you especially if you have a doctor putting you on disability. i want to know if you can please help get some answers to help her. thank you

Under the Family and Medical Leave Act, your friend is entitled to 12 weeks of unpaid leave with her job protected if she has worked for the company more than a year, has worked 1,250 hours in the past year, and the company has more than 50 employees in a 75-mile radius of her job site (I'm guessing that Macy's meets that criteria). Employers do not have to hold a job indefinitely, no matter how compelling the circumstances.

BTW, even CA does not require an employer to hold a job indefinitely. While it is true that CA requires an employer to hold a job for a pregnant woman longer than most states, even CA would eventually allow the employer to cut the cord and hire someone who is able to come to work and do the job.
