Hi - I am hoping you can give me some advise. I work at a small jewelry store which only has the 2 owners
(husband and wife) and 5 employees. I have a full-time job during the day and this is my part time job. I have held both of these jobs for 3 and a half years. I had to get a surgery which I also had a note excusing me from work for 1 week. I did not go to my full time job because it is very stressful and 8.50 hours. I did however go to this part time job because it is only for a couple evening hours. One of the days I was scheduleded to work I did not come in due to exhaustion. I tried to find someone to cover for me but no one would. After that my boss began making a lot of rules including writing the monthly schedule himself. Since I am part time I do not get vacation time at this job. The rules before consisted of submitting a request of days off at the beginning of the month and they would be worked into the schedule. He refuses to do that anymore. He says if I am scheduled and need the day off too bad and I have to work it out on my own. I feel this rule only affects me as a part-timer because anyone full-time is granted vacation requests. He also says if anyone is late or calls off they will automatically be fired. It seems he is trying to trap me in a catch 22. What if I am sick? Another girl has already not come in and she was never even reprimaned about it. Plus a full time employee who has only worked there 2 months cried when she did not get the time off she requested so they changed it for her! I have tried to discuss it with him, he will not change it for me. Would this be considered discrimination, or favortism? It is very unfair. Since this job is a sales based position he seems to only like the people who are selling jewelery. Plus he has recording devices in the store and listens to what we say! I know it is his business and a very small group but I dont belive this is right in the least! Please let me know, thank you

It does appear to be discrimination. Thing is, it doesn't appear to be illegal discrimination. Not all discrimination is illegal; only that which occurs SOLELY due to a legally protected characteristic, such as your age, gender, religion, race, etc.

Nothing in your post indicates that to be the case.
