Hi I have worked for a small new buisness in west tn. for 3 months started in oct. Finally got boss to give me a form to fill out in Dec. to register me in state. I know she hasnt paid any of my payroll taxes in... Along with my previous employer for the jan. of 2005... anyways she wrote my check out wrong for last week shorted me 4.5 hours... when i confronted her she stated that i didnt work i know i did but she then changed her mind to I didnt work that extra hours... She then dismissed me from my job and told me to come back at 4 and get my check.. Went back got check it was still wrong called her ...she said let me check my paper work and got back on the phone and said "how much will it take for me to get you out of my way"...lol I told her all I wanted was what was owed to me... She then stated that if I would of picked up my check that friday it wouldnt be screwed up.. I told her and maybe I shouldnt of if she would know how to run a business it wouldnt be screwed up... She says that her attorney will be in contact with me to give me my money... My ?s are how long does she have to turn my employment with her into the state ? How long does she have to turn in my taxes that she had been taking out since oct 1 2005? can she dismiss me because She messed up on my check and didnt want to pay me for the hours? Also old employer still hasnt paid in my payroll taxes for Jan 05 ... she wants me to estimate my taxes for my w-2 can she do that??

There are no state income taxes in Tennessee. So the fact that she didn't register with "the state" is irrelevant for that purpose. She did need to register with the state Unemployment Agency so she could pay UI taxes (not deducted from your pay); however, she must go back and file whatever returns may still be due and pay the corresponding taxes to the UI agency.

Federal Income tax and FICA/Medicare taxes are paid to the IRS and that requires still another registration with a separate employer ID number.
