A friend works for a public correctional institution in MI for 5 years as a CO. She is married and has 1 child but due to recently becoming ill has to have an emergency hysterectomy. She is depressed because she wants more children, and her husband has left her due to this situation. She works second shift and after work goes out with fellow correctional staff. While at the bar, she talks to one of the psychiatrists and tells him that she is depressed over the recent events in her life. The next day, this psychiatrists tells her boss that she is suicidal and is not fit to come to work. Her boss decides not to allow her to return to work until the psychiatrists feels she is no longer suicidal and capable to return to work. Is there a case here? Can my friend sue for not letting her return to work. Also, is there a breach of confidentiality since she talked to the psychiatrists in a bar and not in a "doctor office"?
