View Full Version : Delayed/Bounced Paycheck

Hi all, first post to his forum. Here's whats happening. I recently started a new job earning alot more than I was before and I'm very satisfied with my job. The thing is that, 3 of my checks have bounced. One of the paychecks were reimbursed. Last Friday was payday, and the lady handing out checks dated the check for this wednesday. When I went to cash my check, NSF. I called the owner of the company and he stated that he would deal with it thursday which was yesterday. I got to work, and he said he was sorry but his check didn't clear that's why he didn't have money and asked me to wait until today friday. My question is, is any of this legal? Can he hand out a check given a certain payday was specified, and make everyone wait almost a week later. Is there anything I can do in regards to a bounced check? This has been happening to most of the other employees as well. Two of the guys here has a $2000 debt in backed paychecks. Is there anything we can do? Please help.

By the way I'm located in nyc queens. And another thing I thought was fishy about this job was that, I never filled out an application, or tax forms or anything. I mean I could of been a terrorist and they wouldn't of known anything. This job was given to be based on a referal but still, if I were the owner of a company, I would do background checks on most of the guys I hire. Thanks again

You can file a complaint of unpaid wages for the bounced checks.

Nothing in the law requires that you be asked to fill out an application or that the employer do background checks. There is nothing "fishy" about that.
