:mad: hi, my name is Fred from NYC. recently i was sent home because i had a cell phone on me. i was not using it i was just simply looking at the time. this happened when my boss went to the basement where i work at. she saw me there talking to somebody. she asked me what was i doing out of my work area. i told her i was waiting for the elevator to come down. she told me to go upstairs now. i told her that i was not going up 31 flights of stairs. she then asked me for the time and being that i don't have a watch i reached for my phone to tell her the time. then all of a sudden she got loud asking me what was i doing with a cell phone. that they were not permitted in the job. i then began to tell her that i had two young kids and that she was not going to tell me that i cant have a cell phone on me. her reply was that she didn't care. i told her that she also has a cell phone and plenty of time i saw her talking on it when i needed to talk to her. she then told me that i was being disrespectful and that what she does is none of my problem. then she then told me to punch out and go home. can u please advice me what action i can take against her

None. I agree that what happened appears unfair, but questioning your supervisor's actions were not a good idea. Nothing illegal occurred here.
