View Full Version : NC overtime question, holiday plus regular time

I work for an engineering contract company.

We are only paid for six Holidays out the year by our contracting company and the company where I work has 14 paid Holidays for their in House full time employees. So I have a lot of unpaid Holidays.

To get to the point. One of my paid holidays was Monday Jan. 2 for New Years day. That week, I got 8 hours paid holiday for Monday and worked 35.5 hours the remaider of the week, for a total for 43.5 hours with counting the paid Holiday.

Now, should the 3.5 hours over 40 hours be at a 1.5x the hourly rate?

I got paid the normal hourly rate for 43.5 hours.

I've worked for other companies and worked on a paid Holiday. With them I receieved the 8 hours for the Holiday plus time and half for the hours I worked on that day.

Please tell me what you know or think.

That is up the to employer. By law, you only have to be paid overtime pay if you WORK more than 40 hours in the workweek.

Go figure. They cheap out on everything else. I am not surprised.

If you are under the impression that 99.9% of other employers are not handling things exactly the same as your employer, you are in for a great surprise. I don't know of too many employers (one, to be specific) who pay overtime on the basis of hours paid as opposed to hours worked. And the one employer I know of who did pay ot on hours paid? They went bankrupt and are now out of business.
