Please help me out. I need to know whether it is legal or not to penalty an employee who leave work for emergency room in GA. I got disciplinary action including wage cut and demotion, because I had to go to emergency room for treatment. I have a serious health problem. Recently, I was attacked by a pang during work. I left work to emergency room. I tried to tell directly to my manager to ask urgent leave for treatment, however she was in meeting, so I couldn’t tell it directly. But, I left a brief message on her desk. After I came back from emergency. She told me I left work without notice and not to make effort to cover my absence by other employees.
I believe that anyone has right to get emergency treatment in case in serious pain. Also no one can punish an employee who leaves work for emergency room.
This action violates basic human rights to live. There must be a law to prohibit this punishment clearly.
I will appreciate your help.
Actually, there is no law that guarantees you the right to leave work to go to the emergency room. It is legal to discipline you for leaving work without permission.
I would want considerably more detail before I would judge whether the employer acted illegally, or even unfairly, or not.
Thank you for replying to me. Let me tell you more details, I have a chronic illness. Recently, I had an attack during work, this sick can be deadly, if I can’t get proper treatment. I was in a serious pain, so I needed immediate leave work. I tried to ask leave directly to my manager, however she was out of office at the time, so I could just leave memo of the situation on her desk. At a hospital in emergency room, I got a medication for treatment. After I came back to work, my manger told me that I made a violation to leave work without permission. As a punishment, she deleted suspended my promotion. I had an informal appointment from other department with much better salary. However, my manager stopped it. The background of this story is that I am an international employee in my company, and I can handle international companies, also I am the only one person who can handle. My manager always tries to prevent me leaving a current position. Last time I almost got a promotion, she told my manager about my chronic illness. After that, my promotion was cancelled, this also sounds illegal, a least extremely unfair. I believe to leave memo was enough effort to ask permission to leave, also to punish an employee for emergency room can threat the right to life. I want to insist that my manger’s treatment was wrong and illegal. Please help me out. Thank you very much.
You can want to insist anything you like, but you still have not posted anything to suggest that your employer violated any laws.
Thank you cbg. I am not familiar with U.S labor law. So, I don't know what kind of specific law is possibly violated by my employer. If you can point any possible violation, please reply. Thanks
