View Full Version : Salary pay if you miss a day.

When I was hired on to the company I work for the hiring manager told me if I missed a day I would not be deducted because I was a salaried employee.

I had to miss 1 day within the 2nd week of employment and this was told to him before I was hired and he agreed to it. I noticed when I received my paycheck that it was not for the full salaried amount. So I questioned him about it. He in turn went and talked to the owner and came back to me and said that until my 90 days was up I would get docked for missing a day. But after that I would not.

Well I had to miss a day a few days ago because I was ill. :( When I got my paycheck once again it was docked for my day. The manager that told me I wouldn't get docked has since moved employment and I have a new manager. I told him what I was told by the previous manager and he said no he doesn't pay if you miss. I work 50 hours a week. I thought the purpose of salary was to not to pay employees overtime. I feel I put in more than enough time and I feel I should be compensated for the missed day. The company gets about 10 hours + off of me a week free. The former manager had talked to the owner and came to me within minutes and said that it was agreed. What to do? :mad:

Depends on whether you are exempt or nonexempt. Salaried is merely a pay method. See here for the definition of "salary basis" when used in conjunction with an exempt employee and under what circumstances an exempt employee's pay can be docked.
