i own small plumbing company in south carolina!!all my employees work a 40 hour week for strait pay!! recently my workers want to work on saturday to make extra hours and have agreed to sign a agreement that if and when they work over forty hours they will only want to make strait time and not over time!! I have read that the FSLA does not require over time pay for work on saturdays,sundays ,holidays or regular days of rest.Extra pay for working weekends or nights is a matter of agreement between the employer and the employee.The FSLA does not require extra pay for weekend or night work or double time pay!! Am i as a employer doing the correct aspect of paying employees if and when they would like to work on their on ommission on sturday for strait time??? thanks

The law does not require a PREMIUM for working weekends or holidays. However, if the employee works over 40 hours in the 7-consecutive day period you (the company) has defined as the workweek, then you must pay overtime for the excess hours. The employee cannot sign away his rights to this benefit.
