View Full Version : Terminated Before Resignation Date (sketchy)

Last year (december) i (not seeing any other avenue) submitted my resignation "verbally". I told them I would submit something in writing (compliant w/ the University's regulations for good-standing termination) after holidays. Upon return...things looked better and I began to resonsider my resignation...and even considered and alternative that had been offered. Six days in to the New year I was given a letter that stated that my resignation had been accepted but that they did not have to accept anything beyond two weeks notice (I gave 2.5 months - verbally) and that upon completetion of me training other staff to take over my duties and closing out things I was already working on that my last date would be 6 weeks earlier than the date I offered. So now I am terminated from my position...did I still "resign" even though I never submitted anything in writing, not even in an email and since they moved my last date up by six weeks. Can I still file for unemployment? I would greatly appreciate any insight. I am still new to Georgia (2 years) and I am not familiar with their labor laws! PLEASE HELP :confused:

I should also add that they are giving me four weeks notice. If you are not required to take more than two weeks notice...my last day should have been last week...but its like they are using me to get things done and then discard as they see fit.

There's no law that says resignations have to be in writing.

What happened is that they chose to accept your verbal resignation. They don't have to accept your stated end date of 2.5 months out, and they could legally have asked you to depart the day you gave your verbal resignation and to not have paid you for any notice.

I'd suggest contacting the unemployment office to see if you qualify.
