View Full Version : Minimum Shifts? On-call?

Hey, everyone...

In my job I am given a company cell phone, and share a company car with another employee. I work four ten hour shifts per week. The day before my first day on the job I either meet the other employee at the store, or he picks me up at my home. We verify inventory and such for about 45 minutes and I take him home. It takes me longer to drive there and back than I actually spend "on the clock". Does WV have a minimum shift time?

On a related note, if my company cell phone rings while I'm off the clock, is there a certain amount of time I am to "bill" the company for? I have heard that a conversation over 2 minutes is to be cited as one hour worked, but have never known for sure.

Can anyone shed some light on the subject?

Regarding your "phone time", assuming you are a nonexempt employee, you only have to be paid for time you are actually working. According to federal guidelines, rounding within 15 minutes has been found to be the outside rounding period. There is no law that says 2 minutes is an hour worked. Neither is there a "minimum shift" or reporting pay requirement in your state.

Regarding the company vehicle, are you required by the employer to go pick up this other employee? Do you do it before your start time or as part of your regular work day? I'm not clear on the details here. :confused:

It seems weird to me that a compnay can require you to be on-call and not have to pay the employee anything unless they work.
To me it is unfair that a company can require someone to be on-call (for however long they want) and never pay them a dime unless they work. Shouldn't employees be compensated for waiting a phone call??

Whether you consider it fair or not, whether the time is compensable under the law depends on the factors I detailed earlier.
