I need to know what child custody laws are in michigan. The situation is that I left my husband due to domestic violence. I have a 3yr and 1yr old. I found out that he was doing coccaine and living with a new gf who is an addict. I don't want my kids around that, or around the abuse. No custody has been decided yet but they are with me most of the time. I cut out vistation untill things get worked out. I want him to take a drug test but one he is saying I have to pay for it and two coccaine only stays in the urine for 24-48hrs. He also will do it and then not do it for a long time. His dad is also a drug addict and his mom has a disaster house and they are always with his mom. His dad broke his thumb hitting his mom. I don't want them around the kids all the time either, especially the house( I have not been able to go in the house since we met which is about 5yrs we were together). What are my options? My lawyer just wants to work things out, but this is going to be impossible with him.

I would keep track of everything that is going on. Has visitation or anything been set yet? You would have to prove, (PROVE) that he is unfit to care for his children so make sure everything is keep track of to the point.

Hopefulyl there are medical records or police reports to document the abuse. If you can prove these things, go to court and pursue sole custody with him receiving only supervised visitation, or no contact if he is currently under the influence of drugs
