The company I work for, list me as a sub contractor, what defines a sub contractor? I get a weekly paycheck form him, I do work he tells me, I do not schedule my hours, also he garnishes wages for use of company vehicle, with out my consent. is this legal? Also he states that I am not covered under workers compensation, I was hurt at a job, and went to the hospital, He states that he isnt turning this in.

Are taxes withheld from your pay? Do you have an independent contractor agreement?

No taxes are taken out, he states it cost too much money,also we never signed an independant contract agreement. I had just found out on tennessee website that He" the owner" doesnt even have a contractor licence, and the business, is in another persons name. Seems like something strange is going on.

Generally speaking, if the company has the right to control your work, including your hours, how you do it, when you do it, provides the tools for you to do it, etc., that is an indication that you are an employee, not an IC, whether or not the company chooses to treat you as one.

It does, in fact, sound like this company is either ignorant of the laws regarding employees, or is just trying to get away with something. You can start with contacting the state Dept. of Labor and move on to the IRS, state Worker's Compensation Division, state Unemployment agency, etc.
