Im a new father and i need help getting started with the whole child support. the babys only 2 weeks old and i would really love to get full custidy of him, becaouse his mom is emotionally unstable, one of the reasons were not to gether. I need to know were i need to go to get process started as far as child support, visiting time, and custidy. at this point the baby is liveing with her, so i need to get this taken care of asap. im in the state of california.

Contact the Family Law Facilitator in your county (or moms if she lives in a different one than you). They will be able to help you out and tell you how to get the ball rolling.

Is the mother unfit to care for this child? Because in most cases you would have to prove she is an unfit mother to gain full custody. Normally they never take a baby away from there mother unless she is proven to be very unfit.

Just a head's up - in order for you to gain full custody (without the consent of the mother) you'd need to prove her unfit which basically means that the child is being abused or severely neglected to the point that it is endangering the child's life. If you just think the mother is highly emotional, that isn't enough. If she is harming the child, and you can prove it, you may have a chance of gaining custody. It has to be really, really bad to take a baby away from its mother, especially one that young.

You do NOT have to prove a parent un-fit in order to get custody. The Womens rights movement took care of that for us. But it will still be a very hard fight. You must prove that it is in the best interest of the Child in order to get what it is that you want.
