on dec 29th, 2005, i called the local police when i found out my 19 year old daughter with a 7 month old baby was leaving to new york for an internet connection with the child. the local police let her go while they told me, the father and the great grandmother to leave until the father and son come from new york to pick her and the baby up. there was no custody order in affect. the local police and told us , it was an order from the da office , she can go. i called the da the next day, he said he cannot give an order over the phone and the only question the police asked , was if they can detain her. being ignorance of the law was used, and that the police are not properly trained on child abduction laws, my granddaughter is now in the state of new york. we have called for 9 straight hours for legal assistance and it seems like the whole world is turning their back. please let me know that i am not going crazy and that what happened is against the law without a custody order, the local law enforcement had no business letting this happen and then tell us to leave and watch it happen?

you stated that your daughter is 19. She is legally emancipated just by her age in every state in the US that I can think of.

unfortunately for a grandparent to have any custodial rights in any state they have to be court ordered.

If your daughter gave birth to the child in question (she does not need a custody order in many states)

your daughter can move to mexico with the grandchild and there is nothing that you can do about it i am sorry to say.

the only possible exception to this is if your daughter is mentally deficient IQ of less than 70 in most states. that would entitle you to a court hearing to keep her your ward or a ward of the state.

get an attorney and file soon after the baby has been gone for over 6 months the new state has jurisdiction.

hopefully your state considers grand parents as having legal rights to file for custody and or visitation many states give grand parents NO legal standing.

rini i didn't explain all circumstances in the first request. she does suffer from mental problems. she had an appointment on feb6th, 2006. the father was standing there with us. i am asking the help on his behalf. our state says that without an order, neither parent can take a child out of state. thats why we thought we were safe. thanks for the response.

rinii also live in pa rini, so if you can help me any more, i have downloaded many laws of pa. the local police in an earlier inncident in nov had told my daughter that she is not aloud to leave the state without a custody order or they would put out an amber alert. the two recent police need alot more training on our pa laws than what they have

hello

file immediately for an emergency hearing.

get the courts to issue a temporary custody order

go get the baby and bring back til final hearing.\

in the meantime prepare a parenting plan and document every moment of the childs life that involved the father past present and future/.
