There are NO circumstances in which an exempt employee is entitled to overtime. Contrary to popular belief, there is nothing in the law which makes it illegal for an exempt employee to clock in and out, and there can be many good and valid reasons for them to do so. It does NOT automatically make you non-exempt. Atkins 01-02-2006, 11:22 AM What qualify's you as non-exempt or exempt?
