I live in Louisiana with my fiancee. His children have been living with us for 3 years. Their mother had little to no contact with them. I even calls for their birthday or Christmas.

She is not a US citizen, but she is trying to become one. She is currently an resident alien who is using someone else's address in the US as her own. She lives in Honduras. She wanted the kids to visit her in Honduras this summer. She signed a notarized letter stating that the kids were to return after the summer for over. She also signed a custody by mandate form giving him custody of the kids. Once the kids arrived in Honduras, we called to see if they arrives safely. That's when she told us that she is not letting the kids come back.

We went to see an attorney to file for custody. We are going to court in January. She said that is not coming back.

I am confused and heart-broken. The kids were attending a private school where they were honor students. By the way, the kids are 7 years old and US citizens. They were involved in sports, and I was involved with the school activities.

I am sorry that this is so long, but I have been nedding to discuss this with people who can be objective. She wants us to send her financial support even though according to US law the kids have been kidnapped. WHAT SHOULD WE DO? She has not even told the kids that they are not coming back. She has been telling them that we abused them. They are at an age where they are very impressionable. We call them as often as we can, but i want them to come back home. IF CUSTODY IS GIVEN TO US, WHAT CAN BE DO TO GET THE KIDS RETURNED TO THE UNITED STATES?

If the children are U.S. Citizens an application should be filed immediately under the Hague Convention ACT.


The Honduras fortunately are a participating country. (since 1992 or 94)

I have helped with this process on one occasion and I am a little familiar with the process.

They should be able to help you. Get the paperwork together and file it immediately.

Even if the children were born there as long as the father is a US citizen I am pretty sure that they can still help you.

You need to see if there is a treaty that Guatemala has with the U.S. regarding parental kidnapping. I suggest that you file charges thru the Guatemalan consultae or embassy, and report it. As a practical matter, you may ahve to go pick up the kids in Guatemala with court order in hand and get counsel down there to ensure legal process occurs to get the kid back.
