I have a legal dilemma and I was hoping to seek your advice. I have a 2-year-old child with a man who was never listed on the birth certificate. I also have a protective order against the father of my child; the order protects us both. He also has 1st degree felony charges of engaging in organized criminal activity due to drugs, but has not been sentenced (3 of the 5 already convicted in the conspiracy have been sentenced to no less than 12 years). I believe he goes to court next month if his attorney doesn’t have it delayed again. He also has pending felony non-support charges as well. (Yes, I know…I picked a winner). I was thinking that I needed to have papers of some sort saying I am sole conservator of my son, but is that necessary since he isn’t even listed as the father? Is that something I need to be worried about? In addition, I’ve always let his parents see my son, but I’m not thinking that is a good idea. Could they even file for grandparents Rights if he isn’t even listed as the father? I just need something drawn up protecting my child. I don’t even care if he’s listed as the father…I’d rather not if truth be known. I’m a broke, full-time student supporting my family on loans and scholarships; however, I feel I need to have something in place. I would appreciate it if you could let me know what legal avenues I need to pursue.

He has no legal rights concerning your son. If a paternity test was done, that would be different. He would have rights, but since he didn't sign at the hospital you can do as you wish for now.

Establish paternity, seek sole custody with no visitation.
