My husband is employed for a seasonal meat cutting operation in Montana. The employer pays wages and taxes on the 4th quarter only - my husband puts ins 60 plus hours a week. Is he entitled to overtime pay? The meat plant does operate year round by owners being the only workers. During the hunting season there is 6-8 employees. Any help you have will be great. This has been going on for several years now- is this employer exempt from paying overtime because he is seasonal?

is this employer exempt from paying overtime because he is seasonal? No. I suggest your husband contact your State's Department of Labor and discuss his situation with them; if the employer is violating wage and hour laws, he is free to file a complaint and the State will investigate.
