I've looked all over, and cannot find any info on the web for a specific question.

My husband has a daughter and a child support order that was set in Louisiana. The child suport is taken out of his check by the state (La). (We live in Alabama)
Due to Hurricane Katrina my step-daughter and her mom(custodial parent) moved to Kentucky. Louisiana is still handling the support, but is it possible to get it out of the courts and set up the payments with the custodial parent herself. The state is taking about 150-200 more than is going to the lil girl because the mom has previously received state assistance. We get along with the custodial parent fine, just wanted to get some info before we talk to her about it, this way we pay less and she gets more money than she is currently receiving. No, because she was on assistance, the order cannot be stopped until the state is repaid. The state WILL get thier money, no matter what.

Even if it were possible to stop the court order, and pay directly to CP, it would be a very foolish thing for your hubby to do. That court order and the fact that payments are made thru the state protects your hubby and the CP.

Good luck getting any help from louisiana.I filed for child support almost a year ago.since the hurricane its slowed down even more.

Doe this apply for Florida ? If you are on assistance? Medicaid? Foodstamps? My order is in Florida but we live in SC and get this assistance here. Do they go after the non custodial ? thanks
Yes, the state that is paying out assistance will go after the NCP for reimbursement, even if the NCP is in another state. If you remain on assistance while CS is being paid, the state will take most of the CS, because you are on assistance.

Wow .. Do they take it out of the ordered amount ? They have not done so yet . How long does it take? It has been 1 year. They know I have cs I gave them copies.
Yes, they will take it out of the ordered amount. If you remain on assistance they may take the entire CS payment, this is because you will recieve the CS in the form of whatever assistance you're on instead of getting the cash CS payment. If you are no longer on assistance, or it stops, they will take a small portion of it, but usually the state will go to modify to have that amount added to the ordered amount as arrears payments.
