Hello all,

I live and work in Indiana, but the company is located in California and our guidelines are per California.

here are some of my questions.

Per our rules and regulations, while on-call we are allowed to log 2 hours per call. The company is now stating that the way we interperet the rules and regs is incorrect and the 2 hours is only for being called out to a site. This same issue came up a month ago and I was paid the 2 hours even though i only worked 1hour. Since they have already paid me and the rules state that we are to be paid 2 hours per call, do I have a leg to stand on?
Is this legal?

I work out of my home. We do not have a local office to work from. I am paid a home office allowance. If I am called to a site or told to go to a site, anywhere from 20-400miles away, should I get paid for the travel and mileage? Or am I forced to deduct the first and last hour of travel?

The company is making it mandatory to take the new company leased vehicle. If I have a car that was purchased and used for 95% for my work, do I have to take the vehicle? If I wanted to keep my car and receive the IRS reimbursement rates, could I, or do I have to cave in?

Your company need to follow Indiana law for your work. However, I will address the issues under California law. If California law provides additional benefits to you, the employer can choose to follow that if they want.

A company can change its pay policies at any time. Unless you have an employment contract, and most people dont, the employer can change your hours, how you get paid, how much you get paid, etc at a whim.

In California, you only need to be paid the reporting time pay (2 hours in this case) when you report to the employers place of business. Thus, simply answering the phone will not entitle you to 2 hours pay even under California law.

Your travel question is Indiana specific, you should post on the Indiana section to get an answer.

A company can make you use a company vehicle for company business.
