Back in 3/2001 I was sick and told by my doctor. I have a condition called Clusterheadaches. These are different than migranes.. as they are called the suicide headaches they come with out notice and the pain will put you to your knees.. I was covered under FMLA.. 2 times i woke with the severe headacheads.. everyone i work with my manager, and all her bosses health services, H/r where aware.. Due to the headaches I failed to call out at the correct time.. I explained what happened.. I was placed on notice.. the second time it happened i was dismissed.. I guess my questions is FMLA covered the time coming in late for the headache but H/R still fired me.. Is this right.. this happened in may and It still bothers me that they fired my unlawfully... Can someone tell me is there anything I can do or should have done... I may be past time to file any kind of greivance Thank you Kelly

Being on FMLA does not give you the right to violate call in procedures. You can be legally fired for violating policy even if the absences are otherwise protected.

And yes, even if your employer acted illegally, which from what you posted it does not appear they did, you are well past the time in which you could file a complaint.
