but she when i do what if she turns around and calls the cops and says that im kidnapping him wouldnt she get in trouble for falsifying an arrest? since she knew what was going on and she signed the paper although its not a legal document but she knew about it.

The only way to LEGALLY take your son to live with you would be for a judge to sign a court order saying that you have custody.

You and your ex can agree that the child will live with you, yes. But legally, SHE will still have physical custody on paper until a judge changes it. If she were to suddenly change her mind, the only legal document you'd have would be the court order saying she has custody and you don't. Then, you could try to use that notarized piece of paper to show intent in a court hearing. Whether it would work or not, no one can tell you.

In my original decree it said that nothing was modifiable between the parties unless in writing, signed by both parties and filed with the courts. My ex agreed for the kids to live with me for a year, it was put in writing and filed as a stipulated agreement with the court. But again... it was filed through the courts and not a notarized piece of paper thrown in a drawer for safe-keeping at home.

no no no. its a total different question. if u noticed i put NOT a legal document. If u didnt tell me yesterday that it wasnt legal then i would have put that its legal. but all i was saying is is it falsifying if she says its kidnapping. Because i was watching the new's like a week ago and they had this girl arrested cause she said her bf kidnapped her son although she gave him permission and cloths and stuff. then she got arrested for lying about the kidnapping.
