Hi. I work for an ATM company in Ohio. We periodically have to get recertified for certain things during the course of the year. My manager says we are not supposed to be compensated for the time we travel to location and time while we are being recertified because he says they already pay for the actual testing. I told him that he is wrong. Am I wrong or right on this issue? thank you very much in advance.

Is the certification required by the state or company to keep your job?
Do you travel locally or out-of-area to take these tests?
Does this testing and/or the travel occur during your regularly scheduled working hours (even if on a nonscheduled work day)?
Do you drive or take other transportation (bus, plane, train, ride as a passenger in another car)?

thanks for responding so quickly. required by the state, in the area but takes atleast a few hours to complete them, we work m-f 7 to whenever we finish our stops which can end up being from 115 to 5. this latest test which is for odot, our manager wants us to go after our stops are done on a shorter day. we have to drive ourselves to all these tests

i forgot to add our other test is done yearly which is for a 4 hour state firearms recertification class on sundays during the day.

This is different from "training". I would contact the state Dept. of Labor and the state Dept. of Transportation to inquire about this particular situation. To tell you the truth, the fact that such certifications are required by state law is the part that confuses the issue. Sorry I couldn't help further.
