Okay the state we are talking about is Alabama/ but I'm currently living in NC

My exhusband is fighting me for custody of my two miner children.
He is now trying to say my current husband has sexually abused my daughter. this isn't true. and we have once again for the 4th time been cleared by DSS.( other matters for dss)
He hasn't allowed me to see my children for two months, and is now refusing to allow me to spend time with the girls unless my husband isn't present in my home.
can he do this?

Is there a visitation order and if so what does it say?

If there is an order that is specific generally the answer is no he cannot do this. HOWEVER, there are exceptions to all things and situations, especially when the issue of a child's welfare is at stake.

If you have a specific order then you need to file contempt. However, be prepared to hear the allegations again and be prepared to defend yourself. Until then if you want to see your children you may want to do it on his terms.
