View Full Version : I need proof for the owner for vacation

I work for a large company in Ohio with 1500+ employees that I'm stating to the HR department that Ohio doesn't have any laws on vacation payouts. I need to show some type of proof for the HR director stating that the company doesn't have to pay out any unused vacation. Thanks

You're going to have to settle for negative proof, because you're not going to find a law that says, Employers need not pay out vacation time at termination.

Since there is no law that says vacation time has to be paid at termination, it doesn't.

Thank you for that info. The last question is this, we also have employees in Michigan, Indiana, WV, and Kentucky. Is this the same for these other 4 states as well? Thanks again.

Michigan: It's a matter of company policy. If an employer has a policy of paying out vacation upon termination, then they must follow it consistently.

Indiana: Has no law regarding the payout of vacation upon termination however the courts have interpreted wages due upon termination to include vacation pay. Empoyees earn vacation simultaneously with wages and other forms of ongoing compensatioin if an employer agrees at the time of hire to pay vacation to an employee and has no agreement or policy to the contrary.

West Virginia: Defines wages as including fringe benefits, therefore earned but unused vacation must be paid out upon termination.

Kentucky: Same as Michigan.

And if your employer wants proof, you're going to have to go to the Dept. of Labor website for each state and find the cite or statement. I, of course, trust Beth to the nth degree. You boss, of course, doesn't know either of us from Eve. :)
