View Full Version : Overpayment of Salary after termination in VA

I worked for a non profit for several years and gave notice in November of 04 that I would be leaving in May of 05 as I was getting married and moving to PA.

Upon leaving in the middle of a pay period; I received a full paycheck May 31. I assumed that since I only had used 1 weeks vacation that I was being paid for my other week that was unused.

After getting married and moving, I was informed that I had been paid twice extra and it was direct deposited into my account. My account had been taken over by my husband and to be short, he had no idea where money came from in my account, only the balance and he paid bills accordingly. Since we married and moved within a short timeframe, we had been depositing wedding money, moving money like mad and inall honesty, I was not looking nor did he think that money was anything other than already there.

Most of that money was spent within the move along with other money we had received both not thinking obviously.

What are my requirements and rights? :(

Your obligation is to return the overpayment to your employer. You do not have any rights under the law to do otherwise.

Hopefully your employer will be willing to allow you to set up a repayment schedule, although the law does not require them to do so.
