hello. i was wondering if anyone could help me figure out how i go about stopping a cchild support order after the custodial mother has died? my son now lives with me but the state of illinois is still taking child support out of my check and i live in tennessee. i really cannot afford an attorney and everyone i call acts dumb about it..i'm getting know answers from the state of illinois child support enforcement. my work says they cant stop the garnishment until they get something from illinois. i really could use some help.. thankyou..sjs

1 get a statement from teachers in school that child attends from your address
2 get statements from grand parents and copy of ex wifes death certificate and send it to court
3 apply that your rule as permanent full custodial parent be recognized in the courts.
4 ask that all funds being held for distribution be released to you.
5 ask for an emergency hearing to establish all of the above including a termination of support

Do you have any idea where the money is going, or if anyone else has been claiming it?
the state may be taking your money now if was being paid by the state but your outa state and have your child so I would call them up and tell them to f*@& off.

No, I'm not a judge or a lawyer. However, I am a person who has researched family law for over 5 years (state and federal) and I've learned alot. I post on this site and others because I firmly believe that the entire family law system is biased and unfair to both CPs and NCPs, and I also firmly believe that KNOWLEDGE of what to do will get better results than sitting around complaining and being angry. When someone posts a question I do my best to help them, you do NOT wish to help, so what- just keep on *****ing and complaining and people will begin to ignore you.
I read some more of your posts. From what I read, you are the father of a child whose mother is a drug addict. Have you ever filed for full custody? have you ever reported the mother to child protective services so that your child can be in a better envirionment? You seem to be very angry and worried- so don't just complain about it- get busy, file for custody and be the good father you claim to be.

Since you know some federal laws regarding these issues I have a quetion 4 u. When my child spprt. order came out in april 2000 I was locked up. now correct me if I'm wrong but isn't it federal law that when a father is doing time they can set an amount but it has 2 be the bare min. as in what a person would make in a 40 hour work week at min. wage? I have been told this is true. well when my ordered support papers from the courts claim that I was in court on that day (impossible) and that I could afford to pay that amount, lies.. well I'm trying to get the court to recognize this mistake and lower my support to that min. about 225$ amonth. Do you have any suggestions as to how I can go about this being that they are allready pissed at me for not showing up. I just couldn't miss christmas cause it will probably be my grandmothers last 1 and I know they would have locked me up anywayz so I have no regrets, but I sure need to fix this and fix it fast I just don't know how. Any answers?? I guess your right xena I need more advice than I can give. Please don't think I'm a bad person 4 the things I say It just really hits home on this subject and I'm totally stressed out. any help would be greatly appreciated. Thanks.
A couple of questions-
What state issued the CS order?
Does the order specifically state that you were present at hearing? Or is it a default order-because you didn't appear?
Were you served with the papers about the petition for CS or the hearing date?
What was the court date that you missed a couple of weeks ago for?
Does the order say anywhere what income they imputed to you?
Have you been making regular CS payments, even if the amount you pay is lower that what was ordered?
The options on what you can do vary, and depend on the answers to the above questions. No, I don't think that you're a bad person. Believe me, with what my husband's ex and the biased Judges have put us through in the last 5 yrs. I've done alot of complaining and cussing myself. The only difference is that my husband/family/friends hear my rants rather than posters on the law sites. But that's just me.
I'll be gone most of the day tommorow so I won't be able to post until tommorow nite.
