I understand there are alot of people asking about legal advice on emancipation. Im currently 16 years old and i live at home with just my mom. Shes been doing all she can to get me out of the house through DCF and DJJ. Because of her I have already spent 13 months in a DJJ facility. My mom did the same thing to my older brother in NY but my moms playing the same game by Floridas rules. She recently called DCF on me and shes being arrained on child abuse charges again (this is the second time) and she is blameing me for this. Im totaly desperate... I have a steady job making 9$ an hour working part time as of right now and if i were to become emancipated there are several people whom i work with who will put me up for a small ammount of money a week. I have no living relatives other than my 34 year old brother who is a rehabilitated drug user and my father who is an abbusive drug addict/alcoholic. I have a drug history myself and i will not allow myself to be put in a situation where id be in that kind of enviroment again. The problem is my mom is refusing to sign any kind of emancipation papers. I would really like to ask if ther is any way to become emancipated without parental consent, through DCF or some other means of court process. Please remember to take into consideration im currently a student in high school (although im going to have to drop out and get my GED) and i have a past drug record and a criminal rap sheet. Based on what you posted, I personally don't believe that you have grounds for emancipation. However, I'm not a Florida attorney so I cannot advise you on the situation. You should contact a family law attorney and schedule a conference where you can tell them every detail and see what they advise you to do.

"I have a steady job..."
- At-will employees never have steady jobs. You can be terminated at any time for a number of lawful reasons. What would you do then?

"I have a drug history..."
- No matter how you put this, it NEVER looks good. This shows a lack of maturity and will factor into your situation.

"...Although im going to have to drop out and get my GED..."
- Tell this to a judge and I guarantee that you won't get emancipated. Although it is necessary to have a flexible schedule when living on your own, education ALWAYS comes first and the judge will not allow you to become emancipated with the intentions to get a GED.

"I have a past drug record and a criminal rap sheet."
- This just adds to the list and puts you far out of range for being granted emancipation.

I would have to agree. It might look a little sketchy in court for you to have such a troubled background and then want to be responsible all of the sudden. I'd say stay put.SRY. Email me at alwayslaughin44@rock.com

i think that you have every right to be emancipated.... you will have to go through the legal action though...i am looking up emancipation records myself on google so i can be....my email is suicidalwishlist@yahoo if you would like to talk
