I work as a drug counselor in the state of Kansas. I have been employed by a county office for 5 years. A background check was not completed when I hired. Today, I have been told that they now want to conduct background checks on all employees. Working in counseling, I have no problems with a background check, however, one of the background forms ask for permission to conduct a consumer credit check. I do not see any connection with a consumer credit report and a background check. My job description has no type of fiduciary responsibilites. I was told if I did not permit the credit check by this "third party," I would be terminated. Is this action allowable under the law? Kansas is a right-to-work state.

Right to work refers to the fact that you cannot be forced to join a union in order to get a job. If you mean an "at will" state, then it means that you can be terminated for any reason that's not prohibited by law.

It is not illegal to perform credit checks on employees, and they are not always limited to employees who have fiduciary responsibilities.
