View Full Version : CA - Unemployment, Restaurant closing for a month

I am a server in a restaurant in California. When I was hired, I was classified within the company as "full-time, permanent" (as opposed to part-time or seasonal).

Every January, the restaurant closes for a month because, historically, it is a very slow month. During the closure, I will not be paid.

I'm confused as to whether or not I'll be eligible for unemployment benefits during this time. Am I considered "laid off?" I know the dates of closure; that is to say, also know my return-to-work date. I guess that part of my confusion is that I read that many teachers are not eligible for benefits during summer recess. My situation seems to parallel that example.

Thanks in advance for any insight to this question. :) I've been trying to find the answer on my own for the last couple of hours!

It is likely you will be eligible for UI benefits during that period. After you work your last day, immediately go file.
