Ok here it goes. I've been working in the trucking industry since 1998 starting out with working for an Armored Car Company. I now work for a company that ships freight.

Here are the questions I would like to have answered if I can.;

1. The Armored car did not pay overtime or mandate us taking breaks.
(The way it was explained to me was the reason they didn't have to pay over time was because their freight went accross state lines and that we were classified as truck drivers.)

2. The company I work for now states that we are required to take a half hour break without pay. They will pay the drivers overtime only after 50 hours.(So now for us to get our 40 hours we must either go in a half hour early or leave a half hour later.)

3. Armored car only required a valid driver's license. The company I work for now requires a CDL.

Who was right? :confused:

They could both be right.

There ARE some exceptions from the federal overtime requirements (to which your state defaults) for interstate truck drivers.

It is also legal for an employer to require that you take a meal period, even though the law does not require it.

Again, the best place for these exceptions is the Dept. of Transportation. Trucking has its own anomalies.
