I work in Northern California, I transfered to another with my job to another location in June. Since June every other paycheck I had direct deposited was 80 hours overpaid. I wanted to do the right thing so I continued to make management aware of the problem to get this fixed. I also had to write the company a check for the overage. However it is still not fixed. On top of that a check I wrote back to the company in September was never sent out. My account has been messed up since.. Is there a time period that they have to recieve the payment before I am able to keep the overpayment?

No, there is not. It's poor business and management practice and indicates a lot of things that need to be improved, but there is no time frame that I know of.

I do not give out specific legal advice on this forum, but if a similar thing happened to me, I would send them a certified letter graciously accepting the unexpected raise that I received and that if the raise was indeed intended, to please keep putting the extra money into my bank account.
