I am a worker from Tennessee. I have injured my back at work. I have reported it to my supervisor and did the necessary paperwork. I am wondering if I am taken off work while on medical leave/workers comp can the company lay me off? I (and 8 others) were offered a lay off for Jan. with a cash pay out, but one stipulation we do not sue the company for any reason once we sign our release (not signed now). Will the company have to wait until I am back on active duty to officially lay me off? I want to make sure my problem is taken care before I am relieved of duty. ( I have worked for this company for 8 years) I do not want to leave and the company drop me from insurance after 6 months and my problem still exists. Any answers will be helpful. Thanks.

You need to consult your workers handbook and a good workers compensation attorney to discuss the best approach. Usually, if you pursue workers compensation, you are not able to sue. BUt if the companyh is laying people off, then even if you win a big award- is it collectable. HArd to say?
